# Terms of Service

## 1. Agreement

These Terms of Service (“Terms”) govern your access to and use of our website, online image editing tools, digital templates, and related services (collectively, the “Service”).

By accessing or using the Service, or by purchasing any digital product through the Service, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use the Service.

## 2. Eligibility

You must be legally capable of entering into a binding agreement under the laws applicable to you.

If you are under the age required to enter into contracts in your jurisdiction, you may only use the Service with the involvement and consent of a parent or legal guardian where required by law.

## 3. Accounts

Some features of the Service may require you to create an account.

You are responsible for providing accurate information and for maintaining the security of your account credentials. You are responsible for activities performed through your account.

You must notify us if you believe that your account has been accessed or used without authorization.

## 4. Digital Products and Templates

The Service provides digital image templates and online editing functionality primarily designed for Original Character (“OC”) creators and enthusiasts.

Templates may contain editable text, images, graphics, layouts, and other design elements.

Depending on the product, you may be required to make a one-time payment to access, use, or download certain digital templates or generated content.

Unless otherwise stated on the relevant product page, purchases are one-time purchases and do not create a recurring subscription.

## 5. License to Use Purchased Content

When you purchase a digital template or other digital product, we grant you a limited, non-exclusive, non-transferable license to use the purchased content for your personal creative projects and other uses expressly permitted by the product description.

Unless we explicitly permit otherwise, you may not:

* Resell, redistribute, sublicense, or commercially distribute the original templates;
* Share purchased template files with other people;
* Make the original templates available for public download;
* Copy or reproduce the templates for the purpose of creating a competing template library or service;
* Remove or circumvent technical restrictions intended to protect the digital products;
* Use our templates or digital products to create a competing commercial template marketplace or service.

The purchase of a digital product does not transfer ownership of the underlying template, design, software, or other intellectual property to you.

## 6. User Content

You retain ownership of the images, text, characters, artwork, and other materials that you upload or create using the Service (“User Content”).

You grant us a limited, non-exclusive license to host, process, reproduce, and technically modify your User Content only as reasonably necessary to operate, maintain, and provide the Service.

We do not claim ownership of your original User Content.

You are solely responsible for ensuring that you have the necessary rights and permissions to upload and use any User Content through the Service.

## 7. Prohibited Content and Use

You agree not to use the Service to:

* Violate applicable laws or regulations;
* Infringe copyrights, trademarks, privacy rights, publicity rights, or other rights of third parties;
* Upload or distribute content that you do not have the right to use;
* Upload malicious code, malware, or other harmful material;
* Upload, create, edit, generate, store, or export pornographic, sexually explicit, or sexually suggestive content;
* Upload, create, edit, generate, store, or export nude or sexualized images intended for sexual purposes;
* Upload, create, edit, generate, store, or export content depicting or sexualizing minors, including fictional or illustrated characters represented as minors;
* Use the Service to facilitate sexual exploitation, abuse, trafficking, or other sexual misconduct;
* Attempt to gain unauthorized access to the Service or its systems;
* Reverse engineer, decompile, or attempt to extract source code from the Service;
* Scrape, copy, or systematically download templates or other protected content;
* Circumvent payment, access controls, or other technical restrictions;
* Interfere with or disrupt the operation or security of the Service;
* Use the Service to create a competing service based substantially on our templates, systems, or content.

For the purposes of these Terms, prohibited sexual content includes content that is explicit, pornographic, erotic, sexually suggestive, fetish-oriented, or otherwise primarily intended for sexual stimulation.

We reserve the right to remove, disable, restrict access to, or delete content that we reasonably believe violates these Terms or applicable laws. We may also suspend or terminate accounts that repeatedly or materially violate these requirements.

## 8. Intellectual Property

All rights, title, and interest in the Service, including our website, software, interface, templates, graphics, layouts, branding, logos, and other original materials, are owned by us or our licensors.

Except for the limited rights expressly granted in these Terms, no intellectual property rights are transferred to you.

You may not use our trademarks, branding, or other proprietary materials without our prior written permission.

## 9. Payments

Certain digital products and templates require payment before they can be accessed or downloaded.

Prices are displayed on the relevant product or checkout page before purchase.

Unless otherwise stated, purchases are one-time payments and are not automatically recurring.

Payment processing is handled by our third-party payment provider. We do not directly store your complete payment card information.

## 10. Refunds

We offer a **7-day no-questions-asked refund policy** for eligible purchases.

If you are not satisfied with a purchased digital product, you may request a refund within **7 days of the original purchase date**, without needing to provide a reason.

Please include your purchase information so that we can identify the relevant transaction.

Once an eligible refund request is approved, the purchase amount will be refunded to the original payment method. The time required for the funds to appear in your account may depend on the payment provider or financial institution.

Unless otherwise required by applicable law, a refund request submitted after the 7-day period may not be eligible for a refund.

Nothing in this policy is intended to limit any mandatory consumer rights that cannot legally be excluded under applicable law.

## 11. Third-Party Services

The Service may use third-party providers for payment processing, hosting, analytics, authentication, storage, or other technical services.

Your use of third-party services may also be subject to their respective terms and privacy policies.

We are not responsible for the availability, functionality, or policies of third-party services that are outside our reasonable control.

## 12. Service Availability

We aim to keep the Service available and functional, but we do not guarantee that the Service will always be uninterrupted, secure, or error-free.

The Service may occasionally be unavailable because of maintenance, technical problems, updates, security incidents, or circumstances beyond our reasonable control.

We may modify, suspend, or discontinue features of the Service at any time.

## 13. Disclaimer

To the maximum extent permitted by applicable law, the Service and digital products are provided on an “as is” and “as available” basis.

We do not guarantee that the Service will meet every individual requirement, produce a particular result, or remain available without interruption.

Nothing in these Terms excludes warranties or rights that cannot legally be excluded under applicable law.

## 14. Limitation of Liability

To the maximum extent permitted by applicable law, we will not be liable for indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Service.

To the extent permitted by law, our total liability arising from your use of the Service will not exceed the amount you paid to us for the specific product or service giving rise to the claim.

These limitations do not apply where liability cannot legally be limited or excluded.

## 15. Indemnification

To the extent permitted by applicable law, you agree to defend, indemnify, and hold us harmless from claims, losses, liabilities, damages, and expenses arising from:

* Your violation of these Terms;
* Your User Content;
* Your infringement of another person's rights; or
* Your unlawful use of the Service.

## 16. Termination

We may suspend or terminate your access to the Service if you materially violate these Terms, engage in fraudulent activity, upload or create prohibited content, attempt to circumvent our payment or security systems, or otherwise misuse the Service.

Termination does not affect rights or obligations that arose before termination.

Sections concerning intellectual property, User Content, payments, refunds, disclaimers, limitations of liability, indemnification, and other provisions that by their nature should survive termination will continue to apply.

## 17. Changes to These Terms

We may update these Terms from time to time.

When we make material changes, we may update the effective date and provide additional notice where appropriate.

Your continued use of the Service after the updated Terms become effective constitutes acceptance of the revised Terms, to the extent permitted by applicable law.

## 18. Governing Law

These Terms are governed by the laws applicable to our business and the jurisdiction in which our business is established, except where applicable consumer protection laws provide otherwise.

If you are a consumer, nothing in these Terms is intended to deprive you of mandatory rights provided by the laws applicable to you.
